Trading Platform Disclaimer

The trading platforms are provided to the Client “AS IS”. To the maximum legal extent allowed by applicable law, warranties and representations, whether explicit, implied, statutory or otherwise, including without limitation any conditions or warranties related to accuracy, currency, merchantability, adequate quality or suitability for a particular or any other purpose are hereby disclaimed and excluded. MTS Bullion shall not be liable for, and Client agrees not to hold or seek to hold MTS Bullion or its officers, directors, employees or agents liable for, any technical problems, system failures and malfunctions, communication line failures, equipment or software failures and malfunctions, and other similar computer problems or defects. In no event will MTS Bullion be liable to Client for any loss, cost, injury or damages (including, but not limited to, punitive, consequential, special or similar damages even if advised of the possibility of such damage) whether in contract, tort (including breach of statutory duty or negligence), strict liability, or otherwise arising out of or caused in whole or in part by Client’s use of or reliance on the software, trading platform or content of any trading platform.

Client understands and acknowledges that the MTS software includes trading systems developed by third parties over whom MTS Bullion has no control and for whom MTS Bullion is not responsible. All orders for trades placed pursuant to indicators generated by the MTS software are at the Client’s sole risk. MTS Bullion makes no representations concerning the performance of any trading systems included in the MTS software or the suitability of the MTS software for use by Client. The MTS software does not take into account any particular individual’s investment objectives, financial situation or needs, and should not be relied upon as a substitute for extensive research. Client should obtain advice based on their unique situation before making any investment decision.

We reserve the right to change the trading platform disclaimer at any time without notice. If we do so, the new version will be uploaded to the trading platform and you will be bound by the updated version if you are still using the trading platform thereafter. By accessing and using the trading platform, you agree that the local laws will apply, and you agree to the exclusive jurisdiction of respective local courts.
